Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of the website operated by Hey, Miss A! (“we,” “us,” “our”) at heymissa.com (the “Site”), including creating an account, requesting sessions, and purchasing downloadable printable activities. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Eligibility and use by adults

Our services are designed for early childhood learners, but the Site and accounts are intended to be used by parents, guardians, and adult learners. By creating an account or making a purchase, you confirm that you are at least 18 years of age and, if acting on behalf of a learner, that you have the authority to do so.

Your account

To access certain features, you may need to create an account. You agree to provide accurate and complete information when registering and to keep your login credentials confidential and secure. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us promptly.

Sessions and bookings

Through the Site you may request learning sessions. Submitting a request is not a guarantee of availability; a session is confirmed only when Hey, Miss A! accepts the request and communicates a confirmation. Scheduling, availability, and pricing are subject to change. Any session-specific terms communicated at the time of booking apply in addition to these Terms.

Shop, purchases, and digital downloads

The Site offers downloadable printable activities for purchase. All payments are processed by our payment provider, Stripe. Prices and availability are subject to change without notice.

• Orders are accepted subject to availability. We reserve the right to refuse or cancel any order.
• Upon successful payment, you will receive access to download the digital files associated with your purchase.
• Access links are intended for the purchaser and may expire or be limited to a reasonable number of downloads.
• If you experience a problem accessing a purchased file, contact us so we can assist you.

License and permitted use of content

Digital products and other content provided through the Site are licensed, not sold. Subject to your compliance with these Terms, Hey, Miss A! grants you a limited, personal, non-exclusive, non-transferable license to download and use the purchased materials for your own personal, household, or single-classroom educational use.

Bundles

Some products may be sold together as a bundle. When you purchase a bundle, you receive a license to each included item on the same terms as individual purchases. Bundle pricing and contents are as displayed at the time of purchase and may change without notice.

Intellectual property

The Site, its design, logos, text, and all materials made available for download are owned by or licensed to Hey, Miss A! and are protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you beyond the limited license described above.

Acceptable use

When using the Site, you agree not to:

• Use the Site in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Site, accounts, or systems
• Interfere with or disrupt the Site, its servers, or the experience of other users
• Submit false, misleading, or fraudulent information, including in bookings or orders
• Reverse engineer, decompile, or otherwise attempt to extract the source of digital products beyond the permitted use above

Payments and billing

By making a purchase, you authorize charges through Stripe for the stated amount. You are responsible for providing valid payment information. Taxes, if applicable, are included or added as displayed at checkout. We may decline or reverse a transaction where fraud or an error is suspected.

Refunds and cancellations

Because our digital products are delivered electronically and can be downloaded immediately, completed purchases of downloadable files are generally non-refundable except where required by law. Session cancellations and rescheduling are handled according to the policy communicated at the time of booking. If you believe an order was placed in error or a file is defective, contact us and we will review your request.

Third-party links and services

The Site may contain links to third-party websites and relies on third-party services such as Stripe and Google. We are not responsible for the content, practices, or availability of third-party sites or services, and your use of them is subject to their own terms and policies.

Disclaimers

The Site and all materials are provided “as is” and “as available” without warranties of any kind, whether express or implied. Educational outcomes are not guaranteed; results depend on many factors specific to each learner. We do not warrant that the Site will be uninterrupted, error-free, or secure at all times.

Limitation of liability

To the fullest extent permitted by law, Hey, Miss A! and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Site, services, or materials, even if advised of the possibility of such damages. Our total liability for any claim arising out of or related to these Terms or the Site shall not exceed the amount you paid us through the Site in the preceding twelve (12) months.

Indemnification

You agree to indemnify and hold Hey, Miss A! harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site or materials.

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict-of-law principles. You agree to submit to the jurisdiction of the courts competent to hear disputes arising from these Terms.
